DIVORCE

In Kentucky, a divorce is deemed “contested” if one or more issues cannot be resolved through agreement between the parties. If a divorce is challenged, it must go through the legal system to be settled. This can be accomplished through alternative dispute resolution (such as mediation) or through litigation.

Domestic violence is a serious issue that affects many families and individuals. It involves abuse, threats, or violence that occurs between family or household members, including spouses or former spouses, dating partners, family members, or co-parents. Domestic violence can take many forms, including physical, sexual, emotional, or economic abuse.

In Kentucky, the court shall determine custody in accordance with the best interests of the child, and equal consideration shall be given to each parent and to any de facto custodian. Joint Custody is one of the option. The visitation rights of grandparents are respected. The wishes of the kid are taken into account.

Child support is a monthly payment made by a parent to assist in covering the costs of raising a child. In Kentucky, both parents are financially responsible for their kid (or children), although only the non-custodial parent normally makes payments. This is because the law presumes that the custodial parent—the parent who spends the most of the time with the kid—spends the appropriate amount of child support directly on the child.

As your kid grows older and his or her needs change, you may request a custody change. You may also do so to safeguard the child’s physical or mental health (for example, in situations of domestic abuse) or if one parent intends to relocate, which may have an adverse effect on the child’s life.

During an appeal, the parties involved will present legal arguments to the higher court in an attempt to persuade them to either uphold the lower court’s decision or to overturn it.

A parent is always free to relocate alone, but the court becomes involved when one parent wants to relocate with the children and the other parent disagrees. Even if a parent has “residential custody” (the kid resides with that parent the most of the time), that parent cannot just pack up and go.

PRENUPTIAL AGREEMENTS

A prenuptial agreement, also referred to as a premarital agreement or antenuptial agreement in Kentucky, is a contract between prospective spouses, signed prior to marriage, that determines how the couple’s assets and debts will divided upon divorce or death of a spouse. Premarital agreements become valid only after the couple is legally married.
