MOVE-AWAY

A parent is always free to relocate alone, but the court becomes involved when one parent wants to move-away with the children and the other parent disagrees. Even if a parent has “residential custody” (the kid resides with that parent the most of the time), that parent cannot just pack up and go. Both parents must agree in writing and submit their consent to the court. If they are unable to reach an agreement, a court will have to make a decision.

The parent who wishes to relocate out of state or by more than 100 miles must notify the other parent at least 60 days in advance. If the parents do not agree, the moving parent will have to ask permission from the family court and the matter will go to trial.
